Customs clearance
Both when importing goods into the territory of the Eurasian Economic Union (EAEU), and when exporting goods, it is necessary to perform certain customs operations. The key operations are: submission of a customs declaration by the importer (exporter) and the release of goods by the customs authority.
These actions are often referred to by one historical term: “customs clearance”.
Such a concept is absent in the current legislation, however, it existed earlier and is so engrained that importers and inspectors still use it.
What is customs clearance?
IFCG specialists divide this process into two stages (these steps are discussed below using the example of import):
1. Preparation (before the import of goods into the territory of the EAEU)
- Preparation of commercial documents (contracts, invoices, etc.) considering customs requirements
- Obtaining of permits (licenses, notifications, certificates, etc.)
- Calculation and payment of customs duties
- Preparation of statutory and registration documents for the registration of the importer as a foreign trade participant
- Other preparatory activities
2. Customs operations (after the actual import of the goods)
- Placement of goods at the customs terminal — temporary storage warehouse
- Preliminary inspection of the goods at the temporary storage warehouse (if necessary)
- Customs declaration
- Responding to customs inquiries, providing explanations on goods
- Customs inspection (when such a decision is made by customs)
- Release of goods by customs
- Receipt of the goods at the temporary storage warehouse (on the basis of a customs declaration marked “release permitted”)
Who is a customs representative (broker)?
Due to the complexity and specificity of the above-mentioned customs operations, the EAEU legislation provides for the institution of customs representatives.
These are companies included in the relevant register and providing customs clearance services to importers (exporters) within the framework of the concluded contract.
