When importing electronic devices on the territory of Kazakhstan, there might be a need to provide the customs with this document.

The opinion is issued by the National Security Committee of the Republic of Kazakhstan (NSC), and it confirms that the imported equipment is not an encryption tool and/or a special technical means for secretly obtaining information.

Opinion of the National Security Committee concerning of attribution of goods to encryption tools and special means for secretly obtaining of information

Importers of electronic goods to Kazakhstan are sometimes faced with the need to provide customs with a document from the competent authority that an imported equipment is not an encryption tool and/or a special technical means for secretly obtaining information.

Special technical means intended for secretly obtaining of information are devices, systems, complexes, special tools for entering premises and/or other objects and software for electronic computers and other electronic devices for accessing information and/or obtaining information from technical means of its storage, processing and/or transmission, which are intentionally given properties to provide the function of hidden obtaining information or accessing it without the knowledge of its owner.

Special technical means intended for secretly obtaining of information include:

  • hidden camcorders;
  • hidden voice recorders;
  • hidden GPS trackers.

Encryption (cryptographic) tools are products intended for encryption of various information or having an encryption function as a non-primary one.

Many products, including consumer goods, may have cryptographic capabilities and are regarded as encryption (cryptographic) tools:

  • tablet computers and laptops;
  • routers;
  • cell phones;
  • software;
  • microcontrollers;
  • other electronic equipment.

In what cases may such a document be required?

If imported goods are included in list 2.17 and/or list 2.19 of Annex 2 by name or HS Code, customs authority may require a conclusion to make sure that the goods do not belong to the encryption (cryptographic) tools and/or to special technical means intended for secretly obtaining of information.

In Kazakhstan such conclusion or an Opinion is issued by the National Security Committee based on an analysis of the submitted documents, including technical documentation.

Obtaining the Opinion of the National Security Committee

  1. Send us the available technical datasheet of a product and HS Code
    At this stage, we will analyze technical characteristics of the product and make sure that the product is really not an encryption tool or special technical means.
  2. We will prepare a complete set of documents for submission to the National Security Committee
    You will need to provide a minimum list of documents: a supply contract, an available description of the goods and a power of attorney for our company (apostilled power of attorney is not required!).
  3. We will submit an application and other prepared documents to the National Security Committee
    We form an application on the Electronic Licensing portal of the Republic of Kazakhstan and sign it with the digital signature of our company.
  4. Obtaining an Opinion
    We receive the document from the National Security Committee and send it to you for submission to the customs.
