Notification of the National Security Committee
The import on the territory of the Eurasian Economic Union (EAEU), as well as the export from this territory of most goods with encryption functions, is carried out on the basis of notification.
Notification is an approved form of notice about technical and cryptographic characteristics of goods, submitted to an authorized body and approved by the body.
When is notification required?
The registered notification (or its registration number) must be presented to the customs authority when importing or exporting goods that have encryption functions and are included in the list of section 2.19.
So, the notification that is necessary for the import of most types of the following goods:
- tablets and laptops (HS 8471),
- routers (HS 8517),
- landlines and cell phones (HS 8517),
- software (HS 8523),
- MCs (HS 8542)
- and other electronic equipment.
Who registers notifications?
Registration of notifications is carried out by authorized bodies in the field of cryptography of the EAEU member states.
In the Republic of Kazakhstan, the National Security Committee of the Republic of Kazakhstan is on duty (hereinafter referred to as the National Security Committee).
In some cases, the product may be included both by HS code and by name in the list of section 2.19, but it does not have encryption functions. In this case, a technical examination is carried out for the attribution of goods to the encryption means and the authorized body — the National Security Committee issues a conclusion.
Registration process of the notification
Electronic submission
Documents for registration of notifications are submitted to the National Security Committee and signed with the electronic signature of the applicant without providing paper copies.
Registration terms
The deadline for consideration of the notification in the National Security Committee is no more than 5 working days from the date of submission of documents. After registration with the National Security Committee, the data is transferred to the Eurasian Economic Commission (hereinafter referred to as the EEC). According to the legislation, the EEC has 3 working days to publish the notification in the Unified Register.
Power of attorney
To submit documents for registration of the notification, a power of attorney from the manufacturer is required.
The power of attorney must be drawn up considering current requirements, signed by an employee of the manufacturing company who has the appropriate authority, notarized and, if necessary, legalized. If the document is in a foreign language, a notarized translation will be required.
